Earn+ Maker Stores Terms & Conditions

1. Introduction

These Earn+ Maker Stores Terms and Conditions (“Store Terms”) govern the creation, operation and use of online stores, product listings, seller accounts, checkout features, buyer orders, reviews, fulfilment and related marketplace services made available through the Earn+ platform (“Platform”).

The Platform is operated in South Africa by Senca Research (Pty) Ltd, registration number 2025/482457/07 (“Senca”, “Earn+”, “we”, “us” or “our”).

These Store Terms apply to all users who create, manage, browse, purchase from, or otherwise interact with Earn+ Maker Stores, including store owners, sellers, buyers, customers and visitors.

By creating an Earn+ Maker Store, listing products, accepting orders, making purchases, or otherwise using the Store features of the Platform, you agree to be bound by these Store Terms, our general Earn+ Terms and Conditions, our Privacy Policy, and any additional policies, guidelines or notices published by us from time to time.

If there is a conflict between these Store Terms and the general Earn+ Terms and Conditions, these Store Terms will apply to the extent of that conflict in relation to Earn+ Maker Stores.

2. Nature of Earn+ Maker Stores

Earn+ Maker Stores allow sellers to create online storefronts and list products or services. Stores may be published while seller verification is underway, but checkout and online payments remain unavailable until the required verification is approved. Sellers may also access advertising, promotion, research, cashback and related business tools offered by Earn+, subject to the requirements for those features.

Earn+ provides the technology platform, storefront tools, payment facilitation, discovery features, advertising opportunities and related marketplace infrastructure. Unless expressly stated otherwise, Earn+ does not manufacture, own, inspect, store, verify, warrant, deliver or supply the products or services listed by sellers.

3. Relationship Between Earn+, Sellers and Buyers

Each seller operates independently and is responsible for their own store, products, services, pricing, descriptions, stock, fulfilment, delivery, after-sales support, returns, refunds, warranties and compliance with applicable laws.

Unless expressly stated otherwise:

Earn+ may facilitate payment processing, provide order management tools, display listings, assist with customer communication, moderate content, suspend sellers, process refunds, or intervene in disputes. Any such action does not make Earn+ the seller, supplier, courier, manufacturer, legal representative or agent of the seller unless expressly agreed in writing.

4. Seller Eligibility and Business Verification

To create and operate an Earn+ Maker Store, a seller must provide the information requested by Earn+, which may include personal, business, banking, tax, contact, address, identity, product and verification information.

A seller must complete the required identity or business verification before checkout and payouts are enabled. Publishing a store does not itself mean the seller is verified. Additional verification may be required for advertising, research campaign tools or other business features.

Earn+ may request, review, approve, reject, suspend or re-open verification at any time where reasonably necessary for fraud prevention, compliance, payment-provider requirements, customer safety, legal risk or platform integrity.

A seller must ensure that all information submitted to Earn+ is true, accurate, complete and up to date. A seller must promptly update their information if it changes.

Earn+ may refuse, suspend or terminate access to Store features if:

5. Personal Information, POPIA and Responsible Party

Earn+ processes personal information in accordance with the Protection of Personal Information Act, 2013 (“POPIA”) and our Privacy Policy.

For purposes of POPIA, Senca Research (Pty) Ltd is the Responsible Party for personal information processed through the Earn+ Platform, including personal information submitted during account registration, seller verification, store setup, order processing, customer support, payouts, reviews, advertising, cashback, research campaigns and fraud prevention.

By using Earn+ Maker Stores, sellers and buyers acknowledge that Earn+ may process personal information for purposes including:

Sellers must only process buyer personal information for lawful order-related purposes, including fulfilment, delivery, customer support, returns, refunds and legally required recordkeeping. Sellers may not misuse buyer information, sell buyer information, add buyers to unrelated marketing lists without lawful consent, or contact buyers outside the Platform for unrelated purposes.

Where a seller independently determines the purpose and means of processing buyer personal information outside Earn+, that seller may be an independent responsible party under POPIA and is responsible for complying with POPIA and other applicable privacy laws.

6. Electronic Transactions and Consumer Information

Earn+ operates in South Africa and intends to comply with applicable consumer-protection and electronic-commerce laws, including the Electronic Communications and Transactions Act, 2002 (“ECTA”) and the Consumer Protection Act, 2008 (“CPA”).

Sellers must make the supplier and transaction information required by ECTA available to buyers, including their legal identity, contact information, product or service details, full pricing, delivery arrangements and return and refund terms.

Each seller is responsible for ensuring that its store, listings, invoices, receipts, customer communications, return details and fulfilment practices comply with applicable consumer-protection, tax, product-safety, advertising, labelling and electronic-commerce laws.

Earn+ may require sellers to provide business details, contact details, return addresses, delivery details, refund policies or other information needed to support compliance with ECTA, the CPA or other applicable laws.

Nothing in these Store Terms limits or excludes any non-waivable rights that a consumer may have under the CPA, ECTA or any other applicable law.

7. Store Creation and Store Content

A seller may create an Earn+ Maker Store using the tools made available by Earn+. The seller is responsible for the accuracy, legality and completeness of all store content, including:

A seller must not upload, publish or display content that is unlawful, misleading, fraudulent, defamatory, discriminatory, abusive, obscene, infringing, unsafe, harmful, spam-like, counterfeit-related or otherwise inconsistent with the purpose and standards of the Platform.

Earn+ may remove, edit, hide, reject or suspend any store, listing, image, description, claim, review or content that Earn+ reasonably considers to breach these Store Terms, applicable law, payment-provider requirements, advertising rules, consumer-protection standards or platform integrity requirements.

8. Product and Service Listings

Sellers must ensure that all listed products and services are accurately described, lawfully supplied, available for sale, safe for their intended use, and compliant with applicable laws.

Each product or service listing must, where applicable, accurately disclose:

Sellers must not list products or services that are illegal, counterfeit, stolen, unsafe, misleading, infringing, prohibited by Earn+, prohibited by a payment provider, or otherwise unsuitable for sale through the Platform.

Earn+ may introduce a prohibited-items policy and may update it from time to time.

9. Pricing, Taxes and Product Availability

Sellers are responsible for setting and maintaining their own product or service prices. Sellers must ensure that prices are accurate, complete and not misleading.

Unless otherwise stated, displayed prices should include any taxes, charges or amounts required by applicable law to be disclosed to consumers. Sellers are responsible for determining and complying with their own tax, VAT, invoicing, accounting and reporting obligations.

Sellers are responsible for maintaining accurate stock availability. If a seller accepts an order for an unavailable item, the seller remains responsible for resolving the issue with the buyer, including replacement, refund or other lawful remedy.

Earn+ may correct obvious platform errors, cancel suspicious transactions, reverse transactions where required, or take steps to protect buyers, sellers, payment providers or the Platform from fraud, abuse or error.

10. Payments, Platform Fees and Commission

Earn+ may enable buyers to pay for orders through third-party payment providers integrated with the Platform.

By using Earn+ Maker Stores, sellers authorise Earn+ and its payment providers to process payments, deduct applicable fees, reverse or refund payments where permitted, and make payouts in accordance with these Store Terms, payment-provider rules and applicable law.

Earn+ may charge sellers fees, including commission, subscription fees, advertising fees, payment-processing-related fees or other platform fees. Unless otherwise agreed or displayed, Earn+ may charge a commission on successful sales made through the Platform.

Earn+ may change its fees by giving reasonable notice, unless a change is required urgently for legal, fraud, payment-provider or operational reasons.

A seller is not entitled to receive payout for an order until Earn+ or its payment provider has successfully received cleared funds and any required verification, fraud, refund, chargeback or compliance checks have been completed.

After delivery to the customer, the seller must mark the order as fulfilled in Earn+. This records the seller’s confirmation that the order has been completed and makes it ready for payout review; a separate buyer-confirmation step is not required. Payment is sent to the seller’s bank account within 24 hours after the seller marks the order as fulfilled, subject to the cleared-funds and checks requirements above and the payout-hold grounds below.

Earn+ may withhold, delay, set off, reverse or deduct amounts from seller payouts where reasonably necessary to address:

11. Shipping, Fulfilment and Delivery

Unless Earn+ expressly provides a specific logistics service in writing, all shipping and fulfilment are the responsibility of the seller.

Sellers are responsible for:

Earn+ may display the message “Shipping is fulfilled by the seller” or similar wording at checkout, on order pages, or in customer communications.

Any delivery time displayed on the Platform is an estimate unless expressly stated otherwise. Earn+ does not guarantee seller delivery times and is not liable for delivery delays, courier failures, damage in transit, loss of parcels or fulfilment failures caused by sellers, couriers, buyers or third parties.

If Earn+ later introduces courier integrations, shipping labels, delivery partners, tracking tools or fulfilment services, additional terms may apply.

12. Orders, Cancellations, Returns and Refunds

A seller is responsible for fulfilling accepted orders in accordance with the listing information, these Store Terms, applicable law and any return or refund policy displayed on the Platform.

12.1 Seller policies

Each seller sets their own returns, refunds and cancellations policy and must make it available on their store. Buyers should check that policy before ordering and contact the seller through the store’s contact button to request a return, refund or cancellation.

A seller’s policy applies subject to these Store Terms and applicable law. It cannot exclude or reduce rights that cannot lawfully be waived. These Store Terms and applicable law continue to apply if a seller has not published a policy or if that policy does not address the issue.

Sellers must handle cancellations, returns, exchanges, refunds, defective products, damaged products, incorrect products and customer complaints lawfully, fairly and promptly.

12.2 Damaged, incorrect or incomplete orders

If an order arrives damaged, incorrect or incomplete, contact the seller through their store within 24 hours of receiving it. Keep the product, packaging and order details, and take clear photos where possible to help the seller and Earn+ assess the issue.

The 24-hour reporting request is intended to help resolve delivery issues promptly. It does not create a 24-hour cut-off for statutory remedies or remove rights under applicable law. A later report must still be considered under the applicable seller policy, these Store Terms and the law.

12.3 Unresolved issues and Earn+ support

Contact the seller first and explain the problem. If you are unhappy with how the seller is handling your issue, or cannot resolve it with the seller, contact Earn+ immediately or email hello@earnplus.co.za. Include your order reference, a description of the issue and relevant correspondence or photos.

Our support team will help resolve the dispute in line with these Store Terms and applicable law, taking account of the seller’s published policy and the available information. Escalation does not automatically entitle either party to a particular outcome, and it does not restrict access to remedies or dispute-resolution channels available under applicable law.

Earn+ may assist with, facilitate, request evidence for, or make a decision regarding a dispute, return, refund or chargeback. Any such action is taken to protect platform integrity and does not make Earn+ the seller or supplier of the relevant product or service.

Earn+ may refund a buyer, reverse a seller payout, or deduct amounts from a seller’s account where Earn+ reasonably determines that a refund, chargeback, reversal or correction is appropriate or required.

12.4 Statutory consumer rights

Nothing in a seller’s policy or these Store Terms limits any non-waivable rights under the CPA, ECTA or other applicable law. These may include remedies for defective, unsafe or misdescribed goods, failed delivery and applicable cancellation or cooling-off rights. The remedy and time period depend on the transaction and the applicable law.

Where section 56 of the CPA applies, a consumer may return goods that do not meet the required quality standards during the six months following delivery and choose a repair, replacement or refund as provided in that section. The supplier bears the return costs and risk, and no penalty applies. These protections are additional to other applicable warranties and statutory rights.

13. Buyer Responsibilities

Buyers are responsible for reviewing product descriptions, prices, shipping details, delivery estimates, seller information, return terms and any other material information before placing an order.

Buyers must provide accurate delivery, contact and payment information. Earn+ and sellers are not responsible for delays, failed deliveries or losses caused by inaccurate or incomplete information provided by a buyer.

Buyers must not abuse the Platform, make fraudulent claims, misuse cashback or promotional features, initiate improper chargebacks, harass sellers, manipulate reviews, or engage in unlawful conduct.

14. Reviews and Ratings

Earn+ may allow buyers to submit ratings, reviews or feedback about stores, sellers, orders, products or services.

Reviews must be honest, lawful and based on a genuine experience. Users must not post fake reviews, paid reviews, defamatory content, abusive content, private personal information, misleading claims, spam or content intended to manipulate ratings.

Earn+ may moderate, remove, hide or restrict reviews where Earn+ reasonably believes a review is unlawful, abusive, false, misleading, irrelevant, fraudulent, retaliatory, manipulated or otherwise harmful to the Platform.

By submitting a review, the user grants Earn+ a worldwide, non-exclusive, royalty-free licence to host, reproduce, display, distribute, adapt and use the review in connection with the Platform, store pages, marketing, advertising, customer trust features and related services.

15. Advertising, Research and Cashback Tools

Earn+ may offer advertising, research, survey, cashback, promotional, insight, campaign or customer-participation tools to sellers, brands, advertisers or other business users.

Additional campaign terms may apply to these services.

A business using advertising, research or cashback tools is responsible for ensuring that its campaign content, claims, targeting, survey questions, incentives, offers, promotions and use of customer information comply with applicable law, including POPIA, the CPA, advertising standards and any sector-specific rules.

Earn+ may reject, pause, remove or modify campaigns where reasonably necessary for legal compliance, user protection, advertiser integrity, fraud prevention, brand safety or platform standards.

16. Prohibited Products, Services and Conduct

A seller may not use Earn+ Maker Stores to sell or promote products, services or content that Earn+ considers prohibited, restricted, unlawful, unsafe, misleading or unsuitable for the Platform.

Without limiting the above, sellers must not:

Earn+ may suspend or remove any seller, store, listing, product, order, payout or campaign where Earn+ reasonably believes there is a breach or risk.

17. Intellectual Property

Earn+, EarnPlus, related logos, designs, taglines, software, interface elements, systems, workflows, copy, graphics and platform features are owned by or licensed to Senca Research (Pty) Ltd.

Sellers retain ownership of their own store content, product images, descriptions, branding and other materials, subject to the licence granted below.

By uploading or submitting content to Earn+, a seller grants Earn+ a worldwide, non-exclusive, royalty-free, transferable and sublicensable licence to host, store, reproduce, display, distribute, promote, adapt, resize, reformat, advertise and otherwise use that content for purposes of operating, improving, displaying, marketing and promoting the Platform, the seller’s store, products, campaigns and related Earn+ services.

Sellers warrant that they own or have the necessary rights to all content they upload, including product images, logos, names, descriptions, trademarks and marketing materials.

18. Store Suspension, Removal and Termination

Earn+ may suspend, restrict, hide, remove, pause or terminate a store, seller account, listing, checkout access, payout access, advertising access, research access or related feature where Earn+ reasonably believes that:

Earn+ may, where reasonable, provide notice and an opportunity to remedy. However, Earn+ may act immediately without notice where urgent action is required.

Suspension or termination does not affect any rights or obligations that arose before suspension or termination, including payment obligations, refund obligations, delivery obligations, indemnities, dispute obligations and legal compliance obligations.

19. Platform Availability and Changes

Earn+ provides the Store features on an “as is” and “as available” basis.

Earn+ does not guarantee that:

Earn+ may update, modify, suspend, remove or discontinue any Store feature, tool, policy, fee, integration, category, campaign type or functionality at any time.

20. Disclaimers

To the maximum extent permitted by law, Earn+ makes no warranties, representations or guarantees regarding:

Nothing in these Store Terms excludes or limits liability to the extent that such exclusion or limitation is not permitted under applicable law, including the CPA.

21. Limitation of Liability

To the maximum extent permitted by law, Earn+ will not be liable for any indirect, consequential, incidental, special, punitive or economic loss, including loss of profits, revenue, goodwill, data, business opportunity, anticipated savings or reputation.

To the maximum extent permitted by law, Earn+ will not be liable for losses arising from:

This limitation does not apply to liability that cannot lawfully be excluded or limited under South African law.

22. Seller Indemnity

Each seller indemnifies and holds harmless Senca Research (Pty) Ltd, Earn+, its directors, officers, employees, contractors, service providers and affiliates from and against any losses, damages, claims, penalties, costs, expenses, legal fees, chargebacks, refunds, regulatory actions or third-party claims arising from or relating to:

This indemnity survives suspension, termination, payout, refund or closure of a seller’s store or account.

23. Buyer Indemnity

Each buyer indemnifies Earn+ from losses, claims, costs and expenses arising from the buyer’s unlawful use of the Platform, fraudulent conduct, improper chargebacks, misuse of cashback or rewards, breach of these Store Terms, infringement of third-party rights, or abuse of sellers, users or Earn+ systems.

24. Payment Providers and Third-Party Services

Earn+ may use third-party providers for payments, payouts, hosting, analytics, messaging, email, identity checks, customer support, shipping tools, advertising tools, research tools or other services.

Use of third-party services may be subject to additional terms, policies, fees, limits and technical requirements.

Earn+ is not responsible for failures, delays, errors, downtime, declined payments, chargebacks, reversals, account holds, payout delays or compliance actions caused by third-party providers, except where liability cannot lawfully be excluded.

25. Records, Audit and Compliance

Earn+ may keep records of seller verification, listings, orders, payments, payouts, refunds, disputes, communications, reviews, campaigns and account activity for operational, legal, tax, accounting, fraud-prevention, audit and compliance purposes.

Sellers must provide reasonable assistance and information where Earn+ needs to investigate fraud, customer complaints, chargebacks, legal notices, payment-provider requests, tax issues, regulatory enquiries or suspected breaches.

26. Notices and Communications

Earn+ may send notices, service messages and legal communications through email, SMS, WhatsApp, in-app messages, dashboard alerts or other contact details provided by the user.

Service messages relating to accounts, orders, payouts, security, verification, disputes, policy changes and platform operations are necessary for the functioning of the Platform and are not marketing messages.

Electronic direct marketing will be handled in accordance with POPIA and the Earn+ Privacy Policy. Marketing messages include an opt-out mechanism. Users may manage their preferences or contact Earn+ to stop receiving marketing messages.

27. Changes to These Store Terms

Earn+ may update these Store Terms from time to time. Where reasonably practical, Earn+ will notify users of material changes by email, in-app notice, dashboard notice or publication on the Platform.

Continued use of Earn+ Maker Stores after the effective date of updated Store Terms constitutes acceptance of the updated Store Terms.

If a seller does not accept the updated Store Terms, the seller must stop using the Store features and may close their store, subject to fulfilling any outstanding orders, refunds, disputes, fees and legal obligations.

28. Governing Law and Dispute Resolution

These Store Terms are governed by the laws of the Republic of South Africa.

For disputes about an order, follow the seller-contact and Earn+ support process in section 12. For other disputes about these Store Terms, contact Earn+ support at hello@earnplus.co.za to seek an informal resolution.

To the extent permitted by law, disputes arising out of or relating to these Store Terms may be referred to arbitration in accordance with the dispute-resolution provisions in the general Earn+ Terms and Conditions, unless another process is required by applicable consumer law, payment-provider rules, court order or regulator. Nothing in this section limits non-waivable consumer rights or access to dispute-resolution channels available under applicable law.

29. General

If any provision of these Store Terms is found to be invalid, unlawful or unenforceable, the remaining provisions will continue in force.

A failure by Earn+ to enforce any provision does not constitute a waiver of that provision.

A seller may not cede, assign or transfer its rights or obligations under these Store Terms without Earn+’s prior written consent.

Earn+ may cede, assign or transfer its rights or obligations in connection with a restructuring, merger, acquisition, sale of assets, financing, platform transfer or corporate transaction.
